Abstract
[Autom. eng. transl.] The Court of Cassation intervenes on the issue of the possibility of reading the expert report in
case of death of the expert during the hearing, denying the possibility of resolving the case
based on the regulation of the reading of documents due to unrepeatable circumstances. The Author, after having reconstructed the consolidated orientation of legitimacy jurisprudence regarding the reading of the expert report, retraces the main arguments of the ruling, questioning the systematic implications of the dictum.
