Abstract

[Autom. eng. transl.] Comment on the ruling of the Joint Sections which addresses the interpretative conflict on the immediate applicability of the art. 573, paragraph 1-bis, c.p.p., introduced by Legislative Decree no. 150 of 2022, to all appeals for civil purposes only pending after the entry into force of the "Cartabia" reform through a careful reading of the system which also suggests certain reflections on the problem, analyzed in close connection, regarding the characteristics of the referral to prosecution before the civil judge.
