Abstract

[Autom. eng. transl.] Noting the decision of the House of Lords in the Jones case, the contribution deals with two fundamental questions: firstly, if the foreign State enjoys immunity from civil jurisdiction in relation to acts of torture committed in its own territory; secondly, whether this immunity should also be granted to individuals, organs of the State, materially responsible for mistreatment.
