Abstract
In antitrust leniency programs, the law doesn’t regulate the probative value of what leniency applicants declare. On one hand, often only such statements can proof secret cartels; on the other hand, however, the companies are unable to provide evidence of their innocence: therefore, before applying the sanction, there should be a reasonable degree of certainty about the offence, taking into account its substantially criminal nature and considered the effectiveness that the sanctioning measure can assume in the judgments for damages. In this context, a critical approach to certain in jurisprudential decisions on the matter appears appropriate.
