Abstract

[Autom. eng. transl.] Reiterating the orientation expressed several times recently, the annotated sentence of the Council of State rejects the thesis that the disqualifying information adopted on an assessment of the 'generic' mafia infiltration attempt (also in the sense of atypical) presents profiles of unconstitutionality or in contrast with the European Convention on Human Rights. The pronouncement has the merit of examining the doubts raised (above all) by the doctrine and of offering an articulated response, exercising a "dialogue" that must be evaluated favorably. However, some critical aspects remain open, the most evident of which seems to be that of judicial protection against prohibitive information.
