Abstract

[Autom. eng. transl.] In the last decade, the judgment of opposition to administrative sanctions before the ordinary judge has undergone significant changes, not so much due to the intervention of the legislator, but as a result of a radical jurisprudential rethinking. Lastly, a ruling by the Supreme Court even seems to entrust the judge with a legality check on the sanction imposed which completely disregards the formulation of the grounds for appeal by the interested party, according to the logic of an objective type of jurisdiction model, in some ways similar to the criminal trial. After analyzing the reasons for this progressive assimilation, the paper critically highlights some implications.
