Abstract

[Autom. eng. transl.] The brief comment on a recent ruling by the Court of Cassation, which concerns the ascertainment of the causal link in matters of medical responsibility, compares the orientation espoused by the ruling, according to which the unknown cause remains with the injured party, with that - rather widespread in jurisprudence - to grant compensation even in the face of "uncertain" damages.
