Abstract

[Autom. eng. transl.] Despite the rather sober title ("Provisions on metropolitan cities, provinces, unions and mergers of municipalities"), law no. 56 of 2014, known as the "Delrio law" (from the name of the proposing minister at the time of the filing of the bill C.1542), can be considered in many ways a "major system reform", recalling - but without any value judgment attached - a definition that has been used by the doctrine closest to the reforming spirit that animates it. More than a year after its promulgation and in consideration of the expiry of the most important terms that it established for its implementation, it is possible to draw up an initial assessment of its results. As with all major reforms - moreover also in a technical-juridical sense when, as regards the institution of metropolitan cities, it qualifies itself as such in relation to some regions with special autonomy - the fundamental question concerns the actual change that the Delrio law has promised and is producing with respect to the previous regulation of the intermediate body and to the local law as a whole. Here, the question will be addressed with reference to the reorganization of provincial functions, which constitutes one of the two pillars of the reform and will be dealt with below considering: the provisions of the law that deal with it; the main implementing measures consisting of the agreement concluded in the State-Regions Conference on 11 September and the decree of the President of the Council of Ministers of 26 September 2014; the bills and the laws for the reorganization of the provincial functions under examination or already approved when this text is dismissed (June 2015), whose review allows to formulate some initial assessments on the general trend of the reform process .
