Abstract
[Autom. eng. transl.] Drawing on a recent jurisprudential case, the essay analyzes the problems underlying the assertion of responsibility of the ASL for the offense of the affiliated general practitioner. The issue is framed in the more comprehensive context of civil health liability, renewed de iure condendo by the most recent law n. 24/2017 (so-called Bianco-Gelli). In the last part of the work, the "systemic" impact of these changes is considered jointly by the Author, who sees a certain convergence of policies between the legislative and jurisprudential formants.
