Abstract
[Autom. eng. transl.] The essay offers a first provisional transcription of the "Replaced Project" of the Criminal Code elaborated in 1806 by Gian Domenico Romagnosi, in response to the request of the Minister Giuseppe Luosi to formulate an opinion on the "Travagli" project, drawn up in the same year by a ministerial Commission established in Milan. It is preceded by some introductory pages aimed at reconnecting Romagnosi's legislative choices to his scientific views and, more generally, to Enlightenment reflection on the right to punish, and tries to focus on the effects arising from the peculiar theory of the ius puniendi elaborated by the Emilian jurist, focused on social defense, in a statistic perspective, which ends up producing the result of attenuating the guarantee function of the penal law.
