Abstract

[Autom. eng. transl.] The author dwells on the procedure for crimes under the jurisdiction of the justice of the peace, in the light of the indications coming from constitutional jurisprudence and legitimacy. The legislative decree n. 274/2000 is inspired by a model of mild justice, through the enhancement of restorative justice and the role of the injured person. Recent reforms seem to attribute a more deflationary rather than restorative vocation to the jurisdiction of the justice of the peace, as evidenced by the inclusion in art. 4 of Legislative Decree no. 274/2000 of "victimless" crimes in the field of immigration. In closing, the Author hopes to be implemented, also with regard to Legislative Decree no. 274/2000, of the delegation in the matter of restorative justice contained in l. n. 134/2021.
