Abstract

[Autom. eng. transl.] The principle of full reparation of the damage runs the serious risk of being circumvented when a plurality of claims for damages for non-pecuniary prejudices are made. The existence of compensation duplications must then be carefully scrutinized in practice, verifying the nature of the damaged interest and its structural diversity with the other non-pecuniary prejudices requested. The two cases of catastrophic damage and damage from upheaval of existence testify to the effort of the jurisprudence to avoid double reparations.
