Abstract

[Autom. eng. transl.] Since the early eighties, investigations into financial scandals have increasingly involved, in addition to the alleged perpetrators of the offenses, even the members of the corporate control bodies on the charge of not having prevented, although they could, the crimes committed by the executive directors or in any case by company executives. The article is a critical reading of the recent Italian jurisprudential practice concerning the criminal responsibility of the members of the corporate control bodies for failure to prevent illegal acts carried out in the context of social management.
