[Autom. eng. transl.] In the complex late-modern era, the sense of generalized crisis is experiencing an unprecedented projection in the criminal law field, translating into the overbearing emergence of the security issue. This Article aims to reflect on the now recurring phrase of 'criminal populism', which expresses precisely the idea of a criminal law conditioned by the pursuit of demagogic purposes and the exploitation of the symbolic components with a view to collective reassurance. After analyzing the common and specific characteristics of the two souls of this phenomenon, namely the legislative and the judicial one, the Author abandons the pars destruens to reflect on the possible alternatives to the existing one.
