Abstract
[Autom. eng. transl.] In recent years, the criminal procedure code has been the subject of numerous and close interventions by the legislator which have put, and continue to put, the legal practitioner face to face with the need for constant and careful updating and a coordinated study of the regulatory stratification that has come into being.
For this reason, there is a strong need for a volume that closes, in a clear and orderly way, the season of reforms of the code of ritual that began with law no. 134/2021 and delegated decree no. 150/2022 and continued with incessant regulatory production up to the most recent provisions including Law no. 168/2023 to combat violence against women and domestic violence and, lastly, Legislative Decree 19 March 2024, n. 31, Supplementary and corrective provisions of the legislative decree 10 October 2022, n. 150.
This volume analyzes the interventions in the field of electronic criminal proceedings and notifications, notification of crime, extension of the possibility of prosecuting a complaint, preliminary investigations, preliminary hearing and trial in absence, extinction of contraventions pursuant to Law no. 283/1962, as well as in matters of special rites.
Not a commentary on the individual modified rules but a tool characterized by clarity, completeness and technical rigor combined with essentiality and which guides the professional through the most relevant issues and highlights the most problematic ones, providing the keys to understanding necessary for "the new code".
The essential focus of the text is the jurisprudential interpretation formed in recent years and not yet settled, with particular emphasis on the interpretative contrasts with which the reader must deal and on the rulings of the Constitutional Court, not only declaring illegitimacy.
