Abstract
[Autom. eng. transl.] The new text of art. 138 of the Insurance Code, as amended by the competition law of 4 August 2017, no. 124. The changes compared to the old formulation and the abandonment of the liability limitation regime in favor of full compensation also in the motor liability and medical liability sector are highlighted, in line with the decisions of the Third Section that are most critical of the balances compensation fixed in the United Sections of 11 November 2008 (so-called San Martino decisions).
