Abstract
The article deals with the regulation of temporary agency work in Germany in the light of the recent reform come into force in 2017. The German legislator, after the liberalisation implemented by the Hartz reform at the beginning of the new millennium, has progressively reintroduced conditions and limits to temporary work: the goal is to make the enterprises use temporary agency work only for purely temporary needs. However, this process of re-regulation risks conflicting with the 2008/104/EC directive, which aims also at revising and removing obstacles to the use of temporary agency work existing in the member States.
