Abstract
[Autom. eng. transl.] Comment on the judgment of the German Constitutional Court of 7 September 2011 on the legitimacy of the European Financial Stability Fund. The Court has denied the unconstitutionality of the law of ratification of the Financial Stability Fund (Euro-stabilisierungmechanismus-Gesetzt) to the extent that, in its practical application, it does not affect the exclusive competences of the Bundestag in matters of the budget. The German Parliament thus maintains full sovereignty in the fiscal sphere.
