Abstract
The contribution reproduces the report given at the conference held in Pisa on 6 May 2022 in honor of Giovannangelo De Francesco. Starting from the theme of the fact of a crime, the Author develops a reflection on the foundations and on the function of substantive criminal law, highlighting its main theoretical and systematic implications.
