Abstract
[Autom. eng. transl.] Starting from its historical and cultural ancestry, the contribution analyzes art. 34 of the Constitution, focusing on the concept of "capable and deserving" to which this provision refers. In particular, the reasons for its failure or incomplete implementation are investigated and an interpretation is sought in light of the principle of equality.
