Abstract
[Autom. eng. transl.] The writing deepens the new case of omitted reclamation pursuant to art. 452-terdecies of the Criminal Code The critical analysis focuses, in particular, on the meaning of the terms 'recovery, restoration and remediation' and of the words 'legal obligation, order of the judge or of an authority', as well as on the relationship between the de norm here and the art. 257 TU environment. Therefore, the reflection shifts from a political-criminal standpoint: by presenting, in cases of omitted reclamation, recourse also to sanctioning instruments other than imprisonment.
