Abstract

The issue of the treatment of the dangerous offender has always been the core of the criminal debate and now is the core of a Bill that is under discussion in the Senate. The paper hinges on this Bill and on the conclusions by the "Stati generali dell'esecuzione penale". The paper focuses on the issue of the social dangerousness of the legally insane and partially legally insane person, adding some remarks about the subject that is guilty but mentally ill, in the light of the provisions embedded in the Bill. Those remarks are made in the perspective of a comparison with the provisions submitted by "Stati Generali" and with the provisions already in force in foreign legal systems. The outcome of this comparison suggests changing the guidelines criteria that is used for the choice of the treatment, moving from the social dangerousness - that is now the guideline criteria - to the need of cure and treatment.
