Abstract
[Autom. eng. transl.] In an era in which 'thoughtfulness' threatens to abandon the daily experience of individuals, one of the problems that most seems to afflict Italian society is undoubtedly the crisis of legality, at least where it is understood as the internalization of shared values that they learn and transmit themselves within the community. The corruption to which this condition is subject, essential for any coexistence, now crosses the entire political-institutional and social context, with the effect of a rarefaction of the regulatory capacity of the legislator, of the concurrent assumption of a leading role by the judiciary and, more generally, the juridical incompetence and the lack of civic conscience of the average citizen. This article aims to reflect on the current state of criminal justice and late modern society, offering conclusively possible solutions to today's degenerative trend.
