Abstract
[Autom. eng. transl.] The growing centrality of relationships based on the "exchange" between user data and apparently free digital services questions the jurist and, in particular, the civil lawyer. This is because a discipline historically impervious to patrimonial logics, such as that of the individual's rights to privacy and protection of personal data, is now forced to "dialogue" with the law of obligations and contracts.
Having overcome the question of the admissibility of such relationships and their qualification in contractual terms, the volume reconstructs their discipline in the light of a complex regulatory framework (including, in addition to national contract law, the GDPR, consumer and competition law ), in light of the most innovative trends in applied law. The volume therefore aims to develop an evolutionary interpretation of the directive on unfair terms in order to protect the freedom of the consumer of "free" digital services, which here suffers further limits compared to the usual information asymmetries towards the professional.
