Abstract
[Autom. eng. transl.] SUMMARY: 1. Premise: the purpose of this contribution. - 2. The principle of adequacy is not an "antagonist" of the principle of subsidiarity, but the two principles, in reality, constitute a unitary principle. - 3. The principle of differentiation is a corollary of the principles of subsidiarity and adequacy. - 4. The principles of uniqueness and responsibility of the administration are, if anything, the true "antagonists", virtuous, of the principle of subsidiarity. - 5. The principles considered are addressed to the legislator, but, in marginal cases, they can also apply directly to public administrations (as in the subject of "self-employment" of the so-called free functions by local authorities). - 6. The principles of subsidiarity and adequacy are "fair" principles. - 7. Conclusion: the principles of subsidiarity and adequacy are principles that do not lack the character of the juridical.
