Abstract

[Autom. eng. transl.] After the Al-Khawaja and Schatschaschwili judgments, the impossibility for the accused to interrogate the decisive witness can be compensated by solid procedural guarantees, provided that the witness's absence from the trial is not attributable to the proceeding authority and was unpredictable in the course of investigations. Less rigor is instead required for the testimony of the absent doubtfully decisive but nevertheless important ", as the balancing factors can be considered sufficient even following a foreseeable absence or in any case attributable to the proceeding authority.
