Abstract
[Autom. eng. transl.] The study deepens the question of the limits to the power of unofficial relief of the jurisdictional defect sanctioned by the art. 37 cpc In particular, recent positions of the Supreme Court aimed at delimiting the detectability of the lack of jurisdiction in appeals (appeal and cassation) are taken into consideration, in order to make the Public Administration responsible for this incumbent .
