Abstract

The essay analyzes the Italian system of Administrative Tribunals and the Council of State from the perspective of the standing conditions. Established that formal laws and case law admit cases of standing with no need to be entitled of a specific right acknowledged by substantial law, the work gives evidence that such hypotheses perfectly fit the Italian constitutional system of administrative justice. Specific consideration is paid to newly introduced standing of the Antitrust Authority against administration deeds infringing national or european competition laws.
