Abstract

[Autom. eng. transl.] The contribution is part of a volume (edited by Damato, De Pasquale and Parisi) that raises in a rational way the most significant jurisprudence of the European Union and of the supreme national courts (with particular attention to the Italian ones) organized by themes pertaining to the law procedural and substantive European criminal law. The first part of the paper deals with evaluating the process by which the EU system has come to enucleate a system of sources aimed at protecting the rights of the person like the one designed above all in art. 6 TEU (Charter of Fundamental Rights of Nice-Strasbourg; general principles of EU law inspired by the constitutional traditions common to the States and the European Convention on Human Rights; future accession to the latter Convention). The jurisprudence of the Court of Luxembourg is noted, which sets out these rules. The EU acts are examined which in the matter of substantive and procedural criminal law apply the principles underlying the exercise of the Union regulatory action incident in the penal juridical fabric of the Member States, with particular attention to the principles of strict criminal legality, guilt, extrema ratio, proportionality, equality and non-discrimination. Therefore the political procedures for controlling the compliance of the Member States in this matter are considered and, finally, the contribution of the Italian national jurisprudence on the subject is summarized as an example.
