Abstract

[Autom. eng. transl.] The paper explores the legal discipline of committees in the Italian legal system, comparing the provisions of the Civil Code with those of the Third Sector Code. The analysis highlights the historical marginality of this legal figure compared to other non-profit entities, such as associations and foundations, but underlines the important role that committees can play in specific contexts, such as emergencies or initiatives of collective interest. In particular, the paper discusses the requirements and characteristics of committees, such as altruistic nature, non-profit and public fundraising, as well as issues related to the liability of administrators and the destination of funds. Furthermore, the possibility of integration between committees and the Third Sector Code is investigated, analyzing potential regulatory adaptations and their recognition as Third Sector Entities (ETS), concluding in favor of the inclusion of committees in the Third Sector framework, provided that they comply with certain structural criteria and civic, solidarity and social utility purposes.
