Abstract
The debate on the «Battelli del Reno» – meaning a transformation
of the social interest in forms that transcend their merely lucrative
character – is considerably topical. Born from the processes of privatisation
and externalisation of public bodies and sharing the subjugation of the
employment of the societal scheme to purposes that were traditionally alien
to it, the hybrid organisms that have thus developed have given rise to
different interpretations as to their legal nature. For criminal law, such
typological evolutions – object of this article’s focus – imply a rethinking
of the notion of public body, so to solve the systematic conflict deriving from
the non-unequivocal criterion adopted, on this point, by the Italian legislator.
