Abstract

[Autom. eng. transl.] The recent border of Italy and Trieste are, in recent history, a symbol of the dramatic conflict between peoples and cultures. Some irredentist intellectuals (Scipio Slataper and Giani Stuparich, among the Giulians, and Cesare Battisti, from Trentino), who volunteered in the royal army during the Great War, elaborated in their literary and political works a profound conception from the so-called "dialectics of boundaries ", which seems an essential point of reflection for the criminal lawyer, called to face the problems of the multicultural society, the tendency to build a criminal law of the enemy and to make the process a tool of revenge and of punishment a means of mere retribution .
