Abstract

[Autom. eng. transl.] The essay examines the way in which, in the jurisprudence of the European Court of Human Rights, art. 3 of the European Convention on Human Rights (on the subject of torture and inhuman and degrading treatment) has begun to be read not only as a source of prohibitions for States, but also as a source of positive obligations.
