Abstract
After having recognized that a person physically or mentally incapacitated may legally
consent to sexual intercourse (as long as the consent is not illegally induced), the essay
explores the impacts of substance abuse on the ability to self-determine and seeks to
evaluate whether the current rules need any amendment
