Abstract

In this article the soundness of some theoretical paradigms of international justice is examined from the point of view the evolution of the international legal system, starting from the end of the second world war. Such an analysis is carried out in a historical perspective, with constant regard to some traditional international law issues (subject, sources, general rules, international responsibility, etc.). The idea is submitted that a moderate, moral cosmopolitan approach fit the international legal system, better than an institutional cosmopolitan model, such as that of Bobbio or Kelsen.
