[Autom. eng. transl.] In the union on the laws of authentic interpretation, perhaps, something is changing: from the traditional deference towards the legislator-interpreter, the Constitutional Court seems to be moving towards greater severity, under the influence of the European Court of Human Rights, despite the discrepancies between the two jurisdictions resounded with clamor in sentence n. 264 of 2012. This impression is drawn from recent constitutional jurisprudence and, in particular, from sentence n. 308 of 2013, commented in the essay.
