Abstract
Building on Maurizio Catino’s empirical analysis of a number of corporate scandals and disasters, and of the related phenomenon of 'organizational scapegoats', this paper discusses some of the contextual elements - including those related to any given legal system - that can generate or strengthen serious bias in the application of criminal provisions, not only with respect to the evaluation of collected evidence, but, upstream, in the very process of selecting, interpreting, and applying the correct legal rules and principles.
