Flessibilità e responsabilità nei contratti e convenzioni tripartiti

[Autom. eng. transl.] The contribution is part of the project financed by MURST - year 2005 - entitled: Instruments for governing the economy and European integration. The research unit in which the work is inserted, coordinated by Prof. Maria Agostina Cabiddu examined, in the panorama of new forms of affirmation of political-institutional decisions in the economic field, those that are placed on the side of loyal collaboration, as a principle capable of generating dialogue and equal comparison between different levels of government. Within the program, entitled: Multilevel institutional agreements: tripartite agreements and contracts, the instruments that local autonomies and in particular the regions have to participate in the definition and implementation of European policies have been the object of investigation. of verification of the effectiveness and efficiency of the consensual instruments with respect to the more traditional methods of connection between different decision-making centers. The prospect of investigation that we wanted to privilege was the attitude of such agreements to constitute a juridical constraint capable of being an expression of the duty of public action. The European legislation on tripartite agreements and contracts was examined, comparing the profile of contractual responsibility with institutional responsibility.
