Abstract

[Autom. eng. transl.] The contribution analyzes the criminal discipline of the crime of market manipulation and focuses, in particular, on the legal nature of the various hypotheses of "exemption" provided for in the TUF The investigation, after having illustrated the different categories of causes of justification, of the causes of exclusion of punishment and of the causes of exclusion of the type and after having critically discussed the category of so-called "procedural justification grounds", analyzes in detail the various "accepted market practices", concluding how they, from the point of view of law criminal, report the absence of the same typicality of the crime of market manipulation.
