Abstract
Although there is no definition as such of
the principle of fairness in positive European
data protection law, fairness of the processing
is related to the balancing of competing interests
and more precisely of fundamental rights
and freedoms of the subjects involved, that
is, on the one side the data subject and on the
other the data controllers and processors
