The Supreme Court of Cassation has overturned its former orientation, resulting from a Court order of 2006, by stating that the merger dissolves the incorporated company: the comment once again examines, albeit from a different and complementary perspective with respect to the work of Prof. Cagnasso already published in this journal, the relationship between dissolution and continuity of legal relationships in mergers, broadening the scope of the analysis also to the issue of the opening of bankruptcy proceedings.
