Abstract

[Autom. eng. transl.] It is a shared position, in jurisprudence, that according to which the chance must be "concrete and effective". What this really means, and how this concreteness must be evaluated, is not clear: the doubt is that - the reflections are conducted with particular regard to the casuistry in terms of medical responsibility - behind the request of a minimum concreteness that the chance should have in order for his loss to be compensable, there are, in reality, other kinds of needs, of a less "objective" nature.
