Abstract

[Autom. eng. transl.] One year after the start of the pandemic crisis, this contribution seeks to carry out a summary reflection on the debate relating to the unexpected appearance of the Prime Minister's Decree as tools available to the Government for the management of situations of cirisi. The distinction between 'general' disciplines and 'particular' emergency disciplines is highlighted, such as those prepared with the various dd. ll. adopted in 2020. Their placement in the source system is examined. The distinction between the 'system of sources' and 'system of public law documents' is taken up again. And, finally, we can see the origin of the problems raised by the atypical government interventions in the tension between the parliamentary state and the administrative state still underlying the implantation of the republican constitution.
