Abstract
[Autom. eng. transl.] The jurisprudence of legitimacy in the matter of information obligations allows the possibility of requesting compensation (pre-contractual) even when the contract is validly concluded. This statement of principle is confirmed by the evolutionary tendencies in the matter of fraud, which, on the assumption that the decipient conduct constitutes first of all an incorrectness in contrahendo, admit - not only in the hypothesis of malicious intent - that when the contract is not voidable because it does not there is in practice a defect of the consent, still deriving compensation consequences pursuant to art. 1337 cc The concomitance with a valid contract of the culpa in contrahendo could put into question the thesis that affirms the extracontractual nature of the latter.
