Abstract

[Autom. eng. transl.] The volume investigates the complex and varied theme of disability from the perspective of public law. Starting from the absence of a homogeneous framework, due to the multiplicity (and sometimes the overlap) of the definitions found in the unorganized Italian legislation and in the jurisprudence, the Author first focuses on the sources that govern disability and, secondly place, on the instruments of public intervention that exist today, bearing in mind that, in protecting the rights that cost, the economic dimension has now assumed a pre-eminent character. The research intends to outline a series of functional criteria for the elaboration of essential levels that aim at a renewed, integrated and community welfare system, as well as of participatory and solidarity type, taking into account that disabled people weigh more and more on families. The proactive part of the work represents therefore a moment of concretization of the attempt of reading on a constitutional level of the phenomenon of disability. The hope is to implement a right against which it is believed that the ways of universalism and the welfare state are still today, despite everything, viable.
