Abstract

[Autom. eng. transl.] The paper reflects on the irrelevance that the dimension of dialogue has traditionally assumed in criminal systems, which have conceived the search for truth exclusively to the detriment of the defendant. From such an orientation we analyze counterproductive aspects with respect to the objectives of prevention and the interest of the victims. This leads to indications for innovative models of criminal litigation management, in the wake of restorative justice and with specific attention to the profile of procedural guarantees.
