Abstract
Traditionally, the dialectic between individual and public interests marks a dividing line between private and public law. However, the dialectic does not only develop along this line, for as branches of public law can assume the protection of the former, so private law provides representation to the latter. The study, built upon a historical investigation, aims to ascertain to what point the private law system can accommodate public interests. To be more precise, it seeks the reasons and the extent to which the private law system can provide representation to public interests in a way that is compatible with the inner logic of the system.
