Abstract
The essay discusses the criminal law aspects of personal data processing. It first addresses the concepts of privacy and personal data protection in the Italian and European context. Il then considers the crimes set out in the Italian so-called Code of privacy, with specific focus on the crime of unlawful processing of personal data. Next, the essay turns to the recently adopted Regulation (EU) 2016/679 on personal data processing, effective in all Member States as of 25 May 2018. In particular, the analysis of the Regulation aims to study its implications in terms of criminal law and administrative liability of companies.
