Abstract

[Autom. eng. transl.] Technological progress, associated with a changed social sensitivity to adverse events, has led to a change in the response of society - and with it the legal system - to the occurrence of natural disasters. If, still in a not too distant past, such phenomena were considered ineluctable fatalities, today these are frequently traced (also) to the conduct of some. Here, then, that if the occurrence of a natural disaster has damaged or endangered the life or safety, public or private, profiles of criminal responsibility may arise for the subject who was required to manage this source of risk. The contribution aims to identify the possible "risk managers", as well as to highlight the legal problems that the practice has brought out in this innovative subject.
