Abstract
The progressive transformation of social contexts elicits to rethink relational models as well as the conceptual pair identity-difference, including the sexual identity. Starting from a legal-methodological approach and reasoning on the liberal perspective it is possible to focus on some points: the problematic notion of “nature”, the communitarian horizon and the role of law, which encompasses the democratic system. The analysis allows to call into question some aspects (the liberal notion of “freedom” and the concept of “identity”) in the light of the practical conflicts which characterize the current public debate.
